The decision was made by Michael Silviano after an hour-long deliberation inside a New Jersey courtroom, with Sean Higgins' attorney and prosecutors.
State officials made the decision to say, Higgins is a danger to the community and should remain in jail.
He has a history of road rage, anger issues, and drinking problems and could self-harm, so it's best that he stays in jail.
Higgins lawyers argue that the 43-year-old is a family man, with two daughters, and had submitted letters to vouch for him. He should be released with conditions, according to his representation.
Judge Silviano mentioned he'd taken into account the submission by Higgins' lawyers, but sided with the prosecutors.
Higgins was seen during the trial, wearing green prison scrubs, and weeping intermittently throughout the hearing.
After the hearing, it was revealed that Higgins had a BAC of .087 when on August 29th, he allegedly crashed into the backs of the Gaudreau's bikes.
Higgins' lawyers argued that he didn't perform the sobriety test well due to a knee procedure he had earlier in the week.
Higgins is facing a charge of two counts of death by auto, which could see him serve 20 years in prison if convicted.
